Terms and Conditions

These terms and conditions relate solely to the provision of a space on a Red Arrow aircraft for a single name (a “Name”) in support of the RAF Museum Centenary Programme Public Appeal. They do not in any way relate to the sale of any other products that appear on the RAF Museum website.

This page (together with the notice setting out the levels of donation and packages (the “Offer Notice”), our Privacy Policy and Terms of Website Use (which can be found at http://www.rafmuseum.org.uk/default/privacy-policy.aspx) tells you information about us and the legal terms and conditions on which we sell a space on a Red Arrow aircraft via the namesonaplane.org website. These terms and conditions, the Offer Notice, the Privacy Policy and Terms of Website Use are referred to together as the “Terms”. In the event that these terms and conditions conflict with our Privacy Policy or Terms of Website Use, these terms and conditions will prevail.

These Terms will apply to any contract for the sale of a Name between the Royal Air Force Museum (“we” or “us”) and you (“you” or “the applicant”) either via our website or other means (the “Contract”).  Please read these terms carefully and make sure that you understand them, before making your donation submitting your application for a Name.  Please note that before submitting your application you will be asked to agree to these Terms.  If you refuse to accept these Terms, you will not be able to submit your application.

You should print a copy of these Terms or save them a soft copy for future reference. Every time you wish to submit an application for a Name, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 31 March 2016.

The RAF Museum can accept no responsibility for, and reserves the right to refuse, applications, which are corrupt, incomplete, lost or damaged, or fail to arrive by the Closing Date (as defined below) or if the available space has been fully allocated.

Your application may be refused if hawse have reasonable grounds to suspect that you may be in breach of these Terms or are otherwise unlawful.

The RAF Museum reserves the right to amend these Terms without prior notice. Any changes will be posted on our website and will apply to all applications received after the date the changes were posted.

To the fullest extent permitted by law, the RAF Museum excludes all warranties, representations, covenants and liability (whether express or implied) regarding the Name on a Place appeal but this shall not exclude the RAF Museum’s liability for death or personal injury as a result of its negligence.

Subject to this, our liability in respect of any item delivered by us (including liability in respect of negligence, breach of contract or breach of statutory duty) will not in any event exceed £[150]. We will not in any event be liable for indirect, special or consequential loss or damage.

By applying for a Name, all applicants agree to be bound by these Terms and submission of an application will be deemed to constitute acceptance of these Terms.

These Terms shall be governed by English law and will be subject to the exclusive jurisdiction of the English courts. 

1.  Information about us

1.1. We operate the website namesonaplane.org (and rafmuseum.org). We are the Royal Air Force Museum, a charity (registered charity no. 244708) with our registered office at RAF Museum, Grahame Park Way, London NW9 5LL.

1.2. Contacting us:

1.2.1. If you wish to contact us, including with any complaints, you can contact us by email at help@rafmuseum.org email address or contact our Customer Services team by telephone on 020 8358 6464.

1.2.2. If we have to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to us in your application. 

2. Names

2.1. The images of Names on our website and marketing material are for illustrative purposes only. Although we will make every effort to display the graphic accurately, we cannot guarantee that the final image will be in the same location.

2.2. Due to limitations of numbers and surface area, name length will be limited to 20 characters.

2.3. An applicant can provide their own name or that of another person, but in all circumstances the name submitted must assign to a real, identifiable, non-fictional individual. Any fictitious names or any name containing any offensive or defamatory content will automatically be rejected. Subject to this paragraph 2.3, we are not responsible for any alternative name submitted and the consent of the named person will be deemed to have been provided to the campaign by that named person. Applications not submitted in accordance with these Terms will, without exception, be invalid and will not be considered.

2.4. Each Name successfully submitted will appear on a Red Arrow aircraft for flight during the 2017 display season. 

2.5. Closing date for donations and applications will be 31 December 2016 or at an earlier date to be advised by us in the event that the available surface area is allocated (the “Closing Date”).

2.6. Applications are non-transferable and accordingly the Name submitted will appear on a Red Arrows aircraft in 2017.

2.7. All successful applicants will receive a Thank You Pack in accordance with paragraph 4 below.

3.  Refunds

3.1. Your donation to us is applicable to charity law.

3.2. Under charity law, charities are not permitted to refund donations, other than in specific circumstances. The Charities Act 2011 can be found here.

3.3. If your Thank You Pack is damaged, then please contact help@rafmuseum.org asap, and we will try to rectify your problem.

4. Thank You Packs 

4.1. Each successful applicant will receive a pack containing confirmation of your submitted application and additional commemorative items and benefits (the “Thank You Pack”). These additional items and benefits will vary depending on the level of your donation.

4.2. Delivery of your Thank You Pack will not take place until 28 days after you have made your donation to us and your items have been checked and packaged. Occasionally our delivery to you may be affected by an Event Outside Our Control. See paragraph 5 for our responsibilities when this happens.

4.3. If no one is available at your address to take delivery, we will leave you a note confirming how alternative delivery can be arranged.

4.4. Delivery of a Thank You Pack and completion of your application shall be deemed to be completed when we deliver the Thank You Pack to the address you gave us. The Thank You Pack will be your responsibility from that time.

4.5. We own the Thank You Pack until full payment has been made and the Thank You Pack has been delivered to you. Responsibility for payment in full, including all applicable delivery charges, remains with you.

4.6. If you order a Thank You Pack from for delivery to an international destination, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these and you will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

4.7. You must comply with all applicable laws and regulations of the country for which the Thank You Pack is destined. We will not be liable or responsible if you break any such law.

4.8. The levels of donation and subsequent prices of the Thank You Packs will be as quoted on our website and will be effective as at the time and date you submit your order. 

4.9. Levels of donations for Names on a Plane may change from time to time, but changes will not affect any order you have already placed.

4.10. The price of a Thank You Pack includes VAT (where applicable) at the applicable current rate chargeable in the UK for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already made a donation in full.

4.11. Your donation does not include delivery charges for the Thank You Pack. Our delivery charges are as advised to you during the check-out process, before you confirm your order.

4.12. Where the Thank You Pack’s correct price is less than the price stated on our website, we will charge the lower amount when dispatching the Thank You Pack to you.

5. Events outside our control 

5.1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in paragraph 5.2.

5.2. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, heavy rainfall, adverse weather, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks (including the internet) or prevention of or substantial delay to the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

5.3. If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:

5.3.1. we will contact you as soon as reasonably possible to notify you; and

5.3.2. our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

5.4. You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at your own cost) any Thank You Packs that you have already received and we will refund the price you have paid, including any delivery charges.
